𓇢𓆸 คำปฏิเสธข้อเรียกร้อง○ The following Terms and Conditions are for Commissions provided by the Artist (InvernoDaisy).○ Commissioning the Artist will indicate acceptance by you of all the following Terms of Service, including changes or modifications of such terms and conditions in the future.
การตกลงว่าจ้างคอมมิชชั่น ย่อมถือได้ว่าท่านได้อ่าน ยินยอม และตกลงที่จะปฏิบัติตามเงื่อนไขตามที่ได้กำหนดไว้ในข้อกำหนดและเงื่อนไขฉบับนี้ หรือในข้อกำหนดและเงื่อนไขที่อาจมีการแก้ไขเพิ่มเติมในอนาคตทุกประการ𓇢𓆸 CONTENT OF SERVICE
𓇢𓆸 เนื้อหาของบริการ○ Complete work is delivered electronically via an online download location in .PNG / .JPG format; this does not include the Commission native files (e.g., .psd, .clip, .ai ), unless agreed upon in the Commission Agreement, or thereafter, the Client obtains written permission from the Artist.
ชิ้นงานที่เสร็จสิ้นแล้วจะถูกส่งผ่านช่องทางการดาวน์โหลดออนไลน์ในรูปแบบของไฟล์ PNG/JPG โดยไม่รวมไฟล์ต้นฉบับ เช่น .psd , .clip, .ai หรือขึ้นอยู่กับความยินยอมของศิลปิน○ The Artist does not provide any service for any AI/NFT related, romanticized social-taboo related contents and those that provoke discriminations , sexual assault/harassment , etc. (i.e. Pedophilia , Child-Adult relationship , Incest , racism , sexism)
ศิลปินไม่รับงานที่มีการเกี่ยวข้องกับAI หรือ NFT ไม่ว่าทางใดและไม่รับงานที่สนับสนุนและเห็นดีเห็นชอบกับการแบ่งแยกเชื้อชาติ การเหยียดเชื้อชาติ การเหยียดเพศ การคุกคามทางเพศ ความสัมพันธ์ที่ขัดต่อศีลธรรมในสังคมและอื่นๆ𓇢𓆸 CLIENT OBLIGATION
𓇢𓆸 ความรับผิดชอบของลูกค้า○The Client must specify the content of the Commission to the best of their ability. The Client is responsible for providing important information and a clear description / reference to the Artist prior to a Commission Agreement. Failing to provide information may result in the Artist’s inability to complete the Commission to the Client’s fullest satisfaction, in which the Client will be held responsible
ลูกค้ามีหน้าที่แจ้งข้อมูลและรายละเอียดสำคัญที่เกี่ยวข้องกับคอมมิชชั่นทุกประการ การแจ้งไม่ครบหรือไม่ชัดเจนอาจส่งผลให้ผลงานที่ออกมาไม่ได้อย่างที่ลูกค้าประสงค์ ซึ่งจะถือเป็นความรับผิดชอบของลูกค้า
○ The Client is obligated to respond to the Artist in a timely fashion. The Artist will not be held responsible for late delivery due to the Client’s negligence of communication. Absence of communication longer than 4 weeks will be considered as cancellation with no refund.
ในกรณีที่ศิลปินติดต่อลูกค้าไม่ได้เกิน 4 สัปดาห์ จะถือว่าเป็นการยกเลิกงานโดยไม่มีการคืนเงิน𓇢𓆸 DESCRIPTION
𓇢𓆸 คำอธิบายงาน○ Display size of the Commission is set at a default maximum resolution of 2079 x 2953 px – 300 dpi (B5) (RGB color mode) Custom display settings of the Commission are available upon request. A larger display size(larger than standard size of A4,A5,A6,B5,B6 ) will incur additional illustration fees, to be defined and agreed upon in the Commission Agreement prior to Start of Work.
กำหนดขนาดไฟล์งานที่ใหญ่ที่สุดอยู่ที่ 2079 x 2953 px – 300 dpi (B5) (โหมดสีRGB).จะมีค่าใช้จ่ายเพิ่มเติมในกรณีที่ลูกค้าต้องการไฟล์งานขนาดใหญ่กว่ามาตรฐาน(A4,A5,A6,B5,B6) โดยต้องตกลงและแจ้งศิลปินก่อนเริ่มงาน○ All prices are as a guide only and may not represent the final price of a particular Commission.
เรทคอมมิชชั่นทั้งหมดเป็นเพียงราคาเริ่มต้นเพื่อไกด์แนะนำเท่านั้น ซึ่งราคาสุดท้ายอาจมีการเปลี่ยนแปลง○Commissions for commercial purposes will incur additional fees (total price*2), to be defined and agreed upon in the Commission Agreement prior to Start of Work.
หากเป็นคอมมิชชั่นเชิงพาณิชย์จะมีการคิดราคาเพิ่มเติม โดยจะ *2 จากราคารวม○ A complex Commission will incur additional illustration fees, to be defined and agreed upon in the Commission Agreement prior to Start of Work.
มีการคิดราคาเพิ่มสำหรับงานที่มีรายละเอียดซับซ้อน โดยเป็นการตกลงราคาก่อนเริ่มงาน𓇢𓆸PRIORITIES OF OFFER
𓇢𓆸การลำดับความสำคัญในการรับงานจากลูกค้า○ Commission offers that satisfy the following components are placed as higher priority than other offers. These components include the Artist's skill level, availability, flexibility of deadlines, and subject matter.
ศิลปินสามารถเลือกรับงานได้ตามความสะดวกส่วนตัว○ The Artist has the right to refuse any Commission request, without needing to explain the reason.
ศิลปินมีสิทธิ์ในการปฏิเสธงานจากลูกค้าได้โดยไม่ต้องแจ้งเหตุผล𓇢𓆸PAYMENT
𓇢𓆸การชำระค่าบริการ○Full payment or ,alternatively, a 50% up-front deposit must be made in the signing of the Commission Agreement prior to the Start of Work.
ชำระก่อนเริ่มงานเต็มจำนวนหรือ 50%In the event that payment is made in installments (i.e. 50% deposit), ownership of the Commission will only pass from the Artist to the Client on receipt of payment in full. The Commission will not be sent to the Client until the agreed payment amount has been received. Any further work on the Commission will be withheld until the agreement is made and payment received.
ในกรณีที่แบ่งชำระค่าคอมมิชชั่น กรรมสิทธิ์ของคอมมิชชั่นจะยังไม่เป็นของลูกค้าจนว่าจะชำระครบเต็มค่าบริการเท่านั้น○ Payment method is determined as written in the Commission Agreement prior to the Start of Work. The Artist’s preferred method of payment is via E-Banking / Promptpay. Additional payment methods can be made available to the Client upon request.
ชำระเงินผ่านทางธนาคาร / พร้อมเพย์○ Currency: All prices are expressed in Thai Baht (THB), and alternatively, US Dollar (USD). It is the the Artist’s responsibility to ensure that they have converted currencies based on current exchange rates.
ใช้สกุลเงิน USD และ THB โดยยึดสกุลเงินไทยเป็นหลัก ทางศิลปินเป็นผู้รับผิดชอบค่าธรรมเนียมในการแลกสกุลเงิน𓇢𓆸REVISION
𓇢𓆸การตรวจงานและการแก้ไขงาน○ Revisions are categorized as major and minor revisions, in which each category has its limits and timing. It is up to the Artist’s discretion as to what constitutes minor and major revisions.
การแก้ไขมีแบบแก้ใหญ่กับแก้เล็กน้อย ซึ่งมีจำนวนโอกาสที่จำกัด ศิลปินจะเป็นผู้ประเมินว่าการแก้ไขที่ลูกค้าขอ เป็นการแก้ประเภทไหน○ The timing and amount of takes in which the Client is allowed revision is to be defined and agreed prior to a Commission Agreement. Extra revision will incur additional fees, also to be defined and agreed upon in the Commission Agreement prior to Start of Work.
จำนวนครั้ง และโอกาสที่ลูกค้าสามารถขอแก้ไขงานได้ จะถูกกำหนดก่อนเริ่มงาน โดยการแก้ไขเกินโอกาสที่กำหนดมีค่าใช้จ่ายเพิ่มเติม○ Revisions due to the Artist’s negligence are free of charge.
การแก้ไขงานที่มีเหตุจากความผิดพลาดของศิลปินจะไม่มีการคิดค่าบริการ𓇢𓆸DEADLINES AND DELIVERY
𓇢𓆸กำหนดจบงาน และการส่งมอบงาน○ This Artist doesn’t accept time-sensitive Commissions
ไม่รับงานเร่งทุกกรณี○ The Artist works on a regular turnaround of 7 to 30 days, unless stated otherwise in the Commission Agreement.
ศิลปินใช้เวลา 7 - 30 วันในการทำงานโดยไม่นับระยะเวลาของคิวก่อนหน้า○ The Artist must give a general indication of how long the Commission will take to complete, and when the Client can expect to receive the finished illustration prior to the Start of Work.
ศิลปินจำเป็นต้องแจ้งระยะเวลาคร่าวๆที่ใช้ในการทำงานให้เสร็จสิ้นไปยังลูกค้าก่อนการเริ่มงาน○ The Artist will inform the Client of progress (including photos) or if changes to completion times have occurred. The Artist is not obliged to explain the reasoning behind extensions or delays for the completion of a Commission.
ศิลปินจะมีการแจ้งความคืบหน้างานให้ลูกค้าลูกค้าทราบ รวมถึงแจ้งให้ทราบหากมีการเลื่อนงาน/ล่าช้า โดยที่ศิลปินไม่จำเป็นต้องแจ้งเหตุผล○ Delivery of complete work is submitted through an online download location (eg. GoogleDrive / Email) for a finite period of time. The Client is obliged to download and store a copy of delivered work before the download location expires.
ส่งงานผ่านช่องทาง GoogleDrive / Email โดยจะเก็บไฟล์งานไว้บนคลาวด์ 4 สัปดาห์ จึงเรียนแจ้งมาเพื่อให้ลูกค้าเก็บไฟล์งานไว้ทันทีหลังจากที่ได้รับงาน𓇢𓆸CANCELLATION
𓇢𓆸การยกเลิกงาน
○ The Artist reserves the right to stop work on a Commission, or cancel a Commission request due to poor communication, rude/inappropriate behavior, an inability to effectively communicate in English or Thai, or a breach of these Terms of Service. The Artist also reserves the right to stop or cancel work in the event of an emergency, accident, or illness.
ศิลปินมีสิทธิ์ในการยกเลิกงานเนื่องจากความบกพร่องในการสื่อสารของลูกค้า ความบกพร่องทางมารยาทของลูกค้า หรือการละเมิดข้อตกลงฉบับนี้ รวมถึงสิทธิ์ของศิลปินในการยกเลิกงานเนื่องจากเหตุสุดวิสัยและอาการป่วยของศิลปิน○ The Client may cancel the Commission only prior to Start of Work.
ลูกค้ามีสิทธิ์ยกเลิกงานได้ก่อนการเริ่มงานเท่านั้น𓇢𓆸REFUNDS
𓇢𓆸การคืนเงินค่าบริการ○ Full refund can be issued if the Client cancels the Artist prior to Start of Work.
ลูกค้าจะได้รับการคืนเงินเต็มจำนวนเมื่อแจ้งยกเลิกงานก่อนที่ศิลปินจะได้เริ่มงาน (การเริ่มงานในที่นี้รวมถึงการส่งภาพร่างอย่างคร่าว ๆ)○ Refunds, as well as unauthorized chargebacks, are not allowed after Start of Work, or if any of these Terms of Service are breached during any period of the commission.

ลูกค้าไม่มีสิทธิ์ขอคืนเงินในกรณีที่ไม่พึงพอใจกับผลงานที่ได้รับ ลูกค้าควรแจ้งความประสงค์ของตนให้ชัดเจน และขอตรวจสอบแก้ไขงานตามโอกาสที่ศิลปินอนุญาตอย่างละเอียด○ Full refund will be issued in the event that the Artist must cancel work due to sudden unavailability or emergency.
ศิลปินจะคืนเงินเต็มจำนวนในกรณีที่ต้องยกเลิกงานเนื่องจากเหตุสุดวิสัยหรืออาการป่วยของศิลปิน𓇢𓆸INTELLECTUAL PROPERTY RIGHTS / COPYRIGHT
𓇢𓆸ลิขสิทธิ์ทางปัญญา○ Original works on the Artist’s website, or at any links associated with this site, and commissions authored by InvernoDaisy are registered and protected under the Copyright Act and may not be used without explicit written permission of the artist.
○ The Artist retains all rights to the commission, which includes but is not limited to: Distribution, reproduction, use of the Commission for Artist promotion (e.g. Profiles, Personal Space, Public Space, as defined in the Definitions section herein, etc.); or as it applies to new Terms of Service agreed upon in a "Transfer of Copyright Agreement" as defined in the Client Documents.
A nondisclosure agreement (NDA) can be requested by the Client. NDA will incur additional fees,which is 20% of total price, to be defined and agreed upon in the Commission Agreement prior to Start of Work.
ลูกค้าสามารถขอสัญญาที่จะไม่เปิดเผยข้อมูลได้ (หรือก็คือหากต้องการให้ศิลปินเก็บผลงานเป็นความลับ ไม่เผยแพร่ ไม่ลง portfolio) โดยที่มีค่าใช้จ่ายเพิ่มเติม +20% ของราคารวม○ The Artist will not reproduce a Copyrighted or Trademarked image or character without expressed written permission of its Copyright or Trademark owner. This applies to Fan Art commission from Copyrighted or Trademarked characters which paid Fan Art is not permitted.
ศิลปินจะไม่ผลิตงานที่มีตัวละครหรือเนื้อหาที่ติดลิขลิทธิ์ซึ่งถูกกำหนดไว้ไม่ให้มีการผลิตซ้ำโดยไม่ได้รับอนุญาตจากเจ้าของลิขลิทธิ์หรือค่ายต้นสังกัด (เช่น การ์ตูนหรือเกมบางค่ายที่ไม่อนุญาตให้ทำรายได้จากลิขลิทธิ์ตัวละครของทางค่าย ซึ่งกรณีนี้จะรวมถึงการไม่รับงาน fanart จากตัวละครที่มีลิขลิทธิ์ดังกล่าวคุ้มครองอยู่○ The Client is to refrain from submitting copyrighted or AI-generated material as composition ideas or inspirational references. Copyrighted material includes artwork from other artists. The Artist will decline requests that suggests heavy-referencing copyrighted material.
โปรดระมัดระวังในการยื่นบรีฟงานที่มีการละเมิดลิขลิทธิ์ หรือบรีฟงานที่ชี้แนะให้ศิลปินละเมิดลิขลิทธิ์ผลงานของผู้อื่น เป็นการป้องกันการเกิด heavy referencing ในคอมมิชชั่น𓇢𓆸REPRODUCTION
𓇢𓆸การผลิตซ้ำ
○ The Artist reserves all reproduction rights, including the right to claim statutory copyright, on all works.
Sale, publication, or repro­duction in any manner is strictly prohibited without prior express, written consent of the Artist. Publication also encompasses social media, including but not limited to: Facebook, Instagram, Twitter, and any other similar platform.
ห้าม repost โดยไม่ได้รับอนุญาตจากศิลปิน รวมถึงการโพสลง social media ด้วยเช่นกัน○ The Client may not distribute, reproduce, or otherwise profit from the Commission, beyond the new Terms of Service agreed upon in a Commercial Purpose Commission Agreement as defined in the Definitions section herein.
ลูกค้าไม่สามารถหารายได้จากผลงานที่เป็นคอมมิชชั่นส่วนตัวจนกว่าจะมีการตกลงและยินยอมจากศิลปิน○ The Client may not edit, alter, or trace the Commission without the Artist’s expressed, written permission, or as agreed upon in the Commission Agreement prior to Start of Work.
ลูกค้าไม่สามารถแต่งเติม ตัดต่อ หรือลอกลายผลงานที่เป็นคอมมิชชั่นได้ จนกว่าจะมีการตกลงและยินยอมจากศิลปิน○ The Client is granted permission to display the commission in Profiles as long as the Artist’s name (InvernoDaisy or under my twitter account user name @InvernoDaisy) is prominently displayed.
อนุญาตให้ลูกค้าสามารถนำงานคอมมิชชั่นขึ้นเป็นภาพโปรไฟล์ได้ หากชื่อหรือแอคเคาท์ทวิตเตอร์ของศิลปินถูกเขียนกำกับบนโปรไฟล์○ Distributing any Commission from the Artist to the NFT / AI site community is strictly prohibited.
ไม่อนุญาตให้ลูกค้านำผลงานที่คอมมิชชั่นจากศิลปิน ไปจำหน่ายหรือกระจายในระบบ NFT หรือ AI เด็ดขาด𓇢𓆸DISPUTE
𓇢𓆸ข้อพิพาท
> In case of disputes, the Artist reserves the right to export communication records (eg. screenshots) between the Client with timestamps. These records will never be shared in a way that would expose the Client, but may be shown to third parties involved in solving the arising dispute.
เมื่อเกิดข้อพิพาทที่เกี่ยวกับงานคอมมิชชั่นของศิลปิน เป็นสิทธิ์ของศิลปินในการเก็บหลักฐานการพูดคุยระหว่างลูกค้ากับศิลปิน เพื่อไกล่เกลี่ยข้อพิพาท โดยจะไม่เปิดเผยตัวตนของลูกค้า

○โปรดอ่าน Term of service อย่างละเอียดก่อนจ้างงาน
○เซ็นสัญญาจ้าง/ใบเสนอราคาก่อนเริ่มงานในทุกกรณี
○ใช้เวลา 7-30 วันในการทำงานต่อภาพโดยไม่รวมเวลารอคิว
○เมื่อจบงานแล้วส่งไฟล์สุดท้ายเป็นไฟล์ jpg , png ทาง Google drive/Email โดยจะเก็บไฟล์งานไว้เป็นเวลา 4 สัปดาห์
○ส่งไฟล์งานหลังโอนเต็มจำนวนแล้วเท่านั้น
○ปกติทางผู้รับจ้างทำงานโดยใช้เลเยอร์เดียว หากผู้ว่าจ้างต้องการไฟล์ PSD โดยการแยกเอเลเมนต์ใดๆโปรดแจ้งล่วงหน้า และจะมีการคิดค่าบริการเพิ่มเติมค่ะ

○ภาพคนเสมือนจริง / Hyperrealisim / Furry / NSFW /Hard Gore (Slightly gore are acceptable)
○หุ่นยนต์ / Futuristic / Cyberpunk

○โดยลูกค้าสามารถแก้งานในช่วงร่างเส้นได้ 2 ครั้ง
○แก้งานในช่วงสเก็ตช์สีได้ 2 ครั้ง
○แก้งานช่วงเรนเดอร์ได้ 2 ครั้ง
○หากมีการแก้นอกเหนือจากนี้ จะมีการคิดราคาเพิ่มเติมตามความเหมาะสม

𓇢𓆸 Pricing

○ราคาที่ระบุไว้ด้านล่างนี้เป็นราคาเริ่มต้น จะมีการบวกราคาเพิ่มขึ้นอยู่กับรายละเอียดของภาพ
สามารถพูดคุยและปรึกษาเพื่อปรับราคาให้เหมาะสมกับงบที่ลูกค้ามีได้ค่ะ
○ราคาที่ระบุไว้ด้านล่างนี้เป็นราคาสำหรับ Personal used เท่านั้น
○ราคาสำหรับเชิงพาณิชย์ x2
○เมื่อเพิ่มตัวละครจะบวกราคาเพิ่มตามรายละเอียดของตัวละครโดยคิดเป็นเปอร์เซนต์ตามราคาเริ่มต้น
